Seller Terms & Conditions

 

Seller Terms and Conditions

This document contains the standard agreement between Royal Pentagon Auction House, (MWWI) and the seller of an item (Seller) wishing to use the MAGMA WORLD WIDE INC(MWWI) online auction service.

 

Authentication: Photos in listings must include all hallmarks or other identifying marks on the item and must include details of any damage or irregularities. Items may be subject to inspection with a black light or other non-destructive testing to verify the authenticity of the item. MAGMA WORLD WIDE INC(MWWI) personnel will review item descriptions and condition reports for completeness and correctness. MAGMA WORLD WIDE INC(MWWI) personnel will answer all Buyer inquiries. MAGMA WORLD WIDE INC(MWWI) reserves the right to refuse items based on disagreements between the Seller and MWWI personnel.

 

Fees: Seller pays a flat fee of 30% of the item online auction price. Seller received 70% of the realized web auction price.

 

Confidentiality and Anonymity: Seller information is confidential and will be released to no one except legitimate Police Agencies with appropriate credentials and documents requesting the release of information. The seller will remain anonymous in all other circumstances.

Right to Refuse Service: MAGMA WORLD WIDE INC(MWWI) reserves the right to refuse service to any individual.

Identification Requirement: In order to use MAGMA WORLD WIDE INC(MWWI) services, the Seller must present a valid photo ID with a current street mailing address. P.O. Boxes are not acceptable. All MAGMA WORLD WIDE INC(MWWI) payments are made by check paid to the name on the Seller’s ID and are mailed to the address on the Seller ID.

 

Approval Period: MAGMA WORLD WIDE INC(MWWI) offers a 5-day approval period on all items. Any item may be returned for any reason during the approval period. If the return is at the Buyer’s discretion, the Buyer pays shipment both ways. If the Buyer can show that the item is not exactly as advertised, MAGMA WORLD WIDE INC(MWWI) reimburses shipment cost along with the refund. The item must be returned in the same condition as shipped to receive a refund. MAGMA WORLD WIDE INC(MWWI) relists items rejected by the Buyer. MAGMA WORLD WIDE INC(MWWI) absorbs the original online auction listing fee and any shipment costs not paid for by the Buyer. MAGMA WORLD WIDE INC(MWWI) may modify the item description and/or condition based on information supplied by the Buyer regarding the reason for item rejection.

Buyer Non-Payment: If a buyer does not pay for a sold item or make specific arrangements to pay for a sold item within 7 days, the item will be deemed unsold unless there is a second high bidder, in which case, the item will be offered to the second high bidder at one bid increment below the winning bid. If the second high bidder does not agree to buy the item, the item is deemed unsold.

 

Unsold Items: The Seller can specify what to do if the item doesn’t sell during the first attempt. This condition occurs when there are no bids at the minimum price or when the reserve amount is not met. The options are:

— Relist the item at a later date with (or without) changes to the minimum price and/or reserve.

— Do not relist the item and hold it for pickup by the consigner. In this case, the item is deemed unsold. If the item does not sell after the second attempt, the item is deemed unsold and is held for pickup by the consigner. The seller is notified via email and post/courier when an item becomes unsold and should be picked up.

 

Offers to Buy Items Below Reserve Price: It is common practice for web auction bidders to offer to buy an item for an amount below the item’s reserve price. If such an offer is made after an unsuccessful auction and the Seller has specified the relisting of the item, the offering party is informed that the item will be relisted. If such an offer is made after an item is deemed unsold, the offer is presented to the seller via email (or post/courier). If the seller agrees to sell the item at the lower price (either via email or post/courier), the sale proceeds as if the item had been sold at a online auction; otherwise, the item stays unsold.

 

Unsold Item Fees: Unsold items will be released to the Seller upon payment of a $6.00 unsold item release fee.

 

Unclaimed Items: Unsold items that are not claimed within 30 days are deemed unclaimed and sold at web auction with a $9.99 minimum price and no reserve. Any proceeds from the sale remaining after satisfying the outstanding MAGMA WORLD WIDE INC(MWWI) fees are disbursed by check to the individual named on the item consignment contract and mailed to the address on the associated photo ID.

 

Email Communication: The Seller is notified of the status of an item during web auction sale process via email. Regular mail is used only for unsold notices, offers made on unsold items, and disbursement of checks.

 

Damaged or Stolen Items: MAGMA WORLD WIDE INC(MWWI) insures items that are damaged or stolen while being held by MWWI prior to shipment to Buyer, for the full price realized at web auction. If damage or theft occurs prior to web auction insertion, an item is insured for the minimum bid or reserve amount specified on the consignment contract, whichever is higher. Once payment is made to the Seller, the damaged or stolen item becomes the property of MWWI. Payment is made to the Seller within two weeks for damaged or stolen items. Recovered stolen items are sold per the original Seller terms and conditions. If the amount recovered through the sale of the item is greater than the amount paid in insurance to the Seller, MAGMA WORLD WIDE INC(MWWI) pays the difference to the Seller. Title passes to the Buyer when the item is shipped. Damage during shipment is the responsibility of the shipper and does not hold up payment to the Seller.

Payment: Payment is made once the Buyer has received the item and the 5-day approval period has lapsed. The time until payment varies based upon the shipment method chosen by the Buyer. The projected payment date is supplied to the Seller via email when the item is shipped.

 

Shipment: Items are shipped once the Buyer’s payment has cleared the EMIRATES bank. Shipment is next day for credit card payments and payments by cash instrument (Money Order or Cashier’s Check). Items are held for 10 days to insure that personal and business checks clear the EMIRATES bank.

 

Title: MAGMA WORLD WIDE INC(MWWI) does not take title to items provided by a Seller for resale, except as provided in Damaged or Stolen Items, above. An item is held in escrow until the auction sale is completed and the item is shipped to the Buyer, or the item is deemed unsold and dealt with through other provisions in this contract.

 

Buyer Expenses: The Buyer pays actual packaging and shipping charges. See Buyer Terms and Conditions for a complete description of services provided to the Buyer.

Excluded Items: The MAGMA WORLD WIDE INC(MWWI) will not accept items that are on the excluded item lists of the top three online auctions. Excluded items include, but are not limited to:

— Explosives Materials

— Alcoholic Beverages

— Prescription Drugs

Photographs: All photographs taken for auction listings are the exclusive property of MWWI.

Buyer Terms & Conditions

Packaging and Shipping Cost: The buyer pays actual packaging and shipping cost.

Authentication: Every effort is made by MAGMA WORLD WIDE INC (MWWI) to provide accurate identification of items through the use of detailed, high-resolution photographs, an accurate description of the item and its condition by a disinterested third party, and detailed, accurate answers to all email queries, including additional photographs if appropriate.

Escrow: The buyer can be sure that the item exists and that the highest bidder (if reserves are met) will be able to purchase the item. All items presented for sale by MAGMA WORLD WIDE INC (MWWI) are held in the MWWI  warehouse until successful web auction sale.

Return Privilege: All items are sold with a 5-day approval period. Any item may be returned for any reason during the approval period. If the return is at the buyer’s discretion, the buyer pays shipment both ways. If the buyer can show that the item is not exactly as advertised, MAGMA WORLD WIDE INC (MWWI) reimburses shipment cost along with the refund. The item must be returned in the same condition as shipped to receive a refund.

Shipment Damage: MAGMA WORLD WIDE INC (MWWI) allows the buyer to choose shipper and insurance amount. Damage during shipment is the responsibility of the shipper. Recovery of cost due to shipping damage is the buyer’s responsibility. In most cases, the recipient of a damaged shipment must file the claim. MAGMA WORLD WIDE INC (MWWI) will work with the buyer to obtain recovery of cost due to shipment damage.

Packaging Guarantee: If damage is deemed by the shipper to be due to improper packaging,MAGMA WORLD WIDE INC (MWWI) will refund the full purchase and shipping amount for the item to the buyer.

Shipment Damage of Returned Items: If a returned item is damaged in shipment, MAGMA WORLD WIDE INC (MWWI) will make every effort to recover the buyer’s cost. If the damage is deemed by the shipper to be caused by insufficient packaging and the buyer has modified the original MWWI, then the buyer is deemed responsible for the damage and no refund is made and the damaged item is repacked and shipped back to the buyer at no charge.

Method of Payment: The MAGMA WORLD WIDE INC (MWWI) web-based interactive payment facility accepts the full range of credit cards. cheques, Demand Draft, money orders and are also accepted via registered post.

Shipment Schedule: Items paid for by credit card or other cash instrument, are shipped on the next scheduled MAGMA WORLD WIDE INC (MWWI) shipping day. Shipments of items paid for by personal or business check are held until payment clears the MWWI bank. MAGMA WORLD WIDE INC (MWWI) currently ships Monday and Wednesday.

Shipping Multiple Items Together: Each MAGMA WORLD WIDE INC (MWWI) sale is a separate transaction that needs to be settled with the owner of the sold item. Our business is geared to sell and ship single items. Our packaging methods are geared to guarantee the safe delivery of the items we ship. Auction Procedure

 

For Seller:

  • Register yourself as a seller with us.
  • Pay the auction arrangement fee.
  • Get the assaying done and the report of your item.
  • Take up to 6 high quality digital photographs of the item.
  • Email us the photographs with the assay report and description of your item.
  • Choose the online auction day and period.
  • Tell us your reserve price (estimated price) which will not be made public.
  • Tell us a bid price to initiate a bid which would be lower value than reserve price.
  • Upon successful auction, you will receive the payment
  • Upon receipt of the payment, pack and ship the item as per the buyer instructions.

For Buyer/Bidder:

  • Register yourself as a bidder/buyer with us.
  • Buy Bids and place your bids.
  • Place your bids.
  • If you are a winner than pay the balance amount and shipping charges.
  • The item will be shipped to your address.

Auctions on MAGMA WORLD WIDE INC (MWWI) site are made very easy. All information is clearly mentioned and self explanatory. On auction house we have number of auction halls, and each hall is having limited number of seating capacity. Seating capacity is indicative of number of registered bidders for each auction hall. The auction starting date and starting price for every auction is clearly mentioned. The price of   each bid also clearly mentioned as Bid Price $ 10/ Bid.  Each placed bid, as set in Auction Parameters the set amount of BIDs deducted from your Bid Account. The amount is set individually for each Auction and located on the button Bid. You can see the remaining time counting down for each Auction (Time left to buy a seat or bid) just above the Bid button. Once the product is displayed on auction hall, we invite bidders to join by purchasing a seat. Once the minimum numbers of seats are being sold, the product is up for live auction. If within the time frame no one wants to buy the item and no bids are received, the item is not sold and the Auction is removed from the website or it can be sometimes it is put up for an Auction once again.

By participating in an Auction you agree to buy the item at the price higher than the current price which is defined Auction parameters. However, if more Bids are received then time is extended by a few minutes/seconds highest bidder wins. The remaining time for each Auction is determined by the current price. Information about the remaining time for bidding can be accessed on the Auction details page under the BID button. If the last bidder who is a winner of the auction is liable to pay the balance amount within the stipulated period, and if he fails to do so the auctioned item will be pass on to next highest bidder.

BIDs and Package Details:

BIDs will be registered on your account as soon as your payment is received and verified. Please note that depending upon the chosen package and method of payment; this can take between few minutes and several days. Before starting to bid on an auction please make sure that you have a sufficient number of BIDs on your account. You can buy credit line and start bidding.

Please note that a BID is not an investment and is non-refundable. A BID represents only the right to participate in an auction. Whether you win the Auction or not, used BIDs are not returned to your account. You can buy items through your bid account balance either debit based or credit based. You have to buy credit line.

To take part in Auctions you must have enough BIDS on your account. Remember to stock up. Having a sufficient supply of bids in your account is essential.

Precaution bid

Some properties on our site allow buyers to present a pre-auction bid to the seller before general bidding is opened. To place a pre-auction bid, locate a product/property you’d like to buy, then click on the “Pre-Auction Bid” button, if available.

  1. Complete the pre-auction bid form to submit a bid to the seller.
  2. You will be asked to provide proof of funds for all cash transactions, present a pre-qualification letter for financeable transactions and provide any applicable entity documents verifying that you are an assigned signer of the contract (if purchasing under a company).
